The death occurred at the Prince County Hospital, Summerside, on Tuesday, October 4, 2005, of Ethel Jay, of 167 Fitzroy Street, Summerside, aged 88 years. Born at Millburn, she was the daughter of the late William and Susan Cobb. She was born in Summerside, the only daughter of the late Harry and Jean Heffell. The death of Reginald B. Praught, of Saint John West, occurred suddenly at the Saint John Regional Hospital on Friday, August 1, 2003. Born in Wellington Centre, PEI, he was the son of Louis Praught of PEI and the late Myrtle Praught. Born at Summerside, he was the son of the late George and Emma Arsenault, and was the last surviving member of his family.

Aeneas was born in Bloomfield, P.E.I. to the late Pius and Lillian Gallant. Beloved husband of Sandra Gallant and loving father of Catherine Rowden, Paul and Shane . Predeceased by his parents, brother Jim, sister Sharon and brothers-in-law Leo and George. Pre-deceased by his parents and sisters Lorraine Foley and Rita Griffo. A celebration of this magnificent man’s life will occur at a later date.

He was predeceased by two brothers, Errol and Junior Praught, one sister-in-law Sheila. Predeceased by her husband Aubin Gallant; by sons Everett and Ralph; two daughters in infancy; a grandson James Aubin; brothers Lloyd, William and Vernie Gallant; and by a sister Lena DeCoste.

A portion, or all, of each party’s deposit, may be retained by the Panel to cover the costs incurred by the Panel up to the point of the settlement of the dispute. All notices required in this procedure will be made by personal service or certified mail, return receipt requested or by email if a board/association has adopted electronic notification.

If more than one party requests copies of the transcript, the Panel’s costs will be apportioned between or among the parties. Parties, at their own expense, may have legal counsel present during the hearing. If a party intends to have legal counsel present at the hearing, the party must provide written notice to the Panel Chairman and the other party, not less than fifteen days before the hearing date.

Along with the reply, the respondent shall submit a deposit of $500 when the dispute is submitted to NYSAR. The deposit may be returned or may be retained by the board/association to be used toward the cost of the arbitration hearing The Executive Officer shall send a copy of the response not sooner than fifteen days nor later than twenty-one days after mailing notice to the respondent of the request for arbitration. If a member fails to comply with an award, the recipient to whom the award has been rendered by the Arbitration Panel shall be advised by the Hearing Panel to seek judicial enforcement and request reimbursement of all legal costs incurred in seeking judicial enforcement.

In this event, any deposits made by the parties shall be returned to the parties. Further, if the panel determines that an arbitrable matter exists but it is not subject to mandatory arbitration, neither party may be compelled to arbitrate, and the arbitration shall terminate unless all parties voluntarily agree to take part and abide by the decision. All parties to the dispute shall present to the arbitrators’ such statements and proof which they deem necessary to support their claims. Proof may be in the form of affidavits or otherwise. The arbitrators shall receive written statements, documents or other papers shall hear oral testimony.

Ethics complaints serve to educate members as well as provide a disciplinary process when violations have occurred. Any person having reason to believe that a member is guilty of any unethical conduct subject to disciplinary action may file a complaint in writing with the Local Board/Association of REALTORS® that the member holds membership in. Dissemination of the award shall be limited to the parties involved, on a need to know basis, and to legal counsel and staff. The Outline of Procedure For Ethics or Arbitration Hearings (Part Thirteen, Form #A-10 in NAR’s Professional Standards Manual) should be made available to the parties involved in advance of the Hearing. The Hearing Panel may receive and consider any evidence they deem material and proper. Parties to arbitration shall be entitled to have legal counsel present at any hearing. Each party is responsible for the expenses of his/her respective counsel. The determination as to whether an arbitrable matter exists shall be made by the local Board/Association’s Grievance Committee pursuant to those procedures outlined in Part 10, Section 47 of the Code of Ethics and Arbitration Manual. Appeals of arbitration requests dismissed by the Grievance Committee and alleged misclassification of an issue as being subject to either voluntary or mandatory arbitration shall be considered by the Board of Directors of the local board or by a panel of Directors. The Executive Officer shall notify the respondent that he/she must file a written reply in response to the arbitration request within days of the date of the mailing to the respondent.

Never once did I see poor workmanship and “good enough” scenarios from the workers. We did our first walk-through prior to the interior finishing and approved everything since there were no surprises. A couple or so months later, we did our second and final walk-through just prior to our taking possession and brought in an expert to assist us. The house was structurally very sound and the finishing was expertly done with a few cosmetic details that were quickly taken cared of prior and shortly after we moved in. Next was the real fun part – selecting all of the materials that went into finishing our house such as flooring, counter tops and cabinets, type and colour of bricks and siding.

We really wanted to build an ‘ultra-modern’ home with lots of windows for natural light and wanted to have a gorgeous pond view from our backyard. The design center had lots of options and all different kinds of upgrades available. After compiling a few notes on various home builders, we set out to visit their model home sites.

Without exaggeration, buying my first home from this builder has been the worst five years of my life emotionally, legally and fiscally. Ask anybody in my neighborhood about their workmanship. This is the worst home builder you will ever come across. Not only do they have no design options that are standard and nice, everything is an unreasonable upgrade. Expect your home to be delayed by 2 or more years. This home buyer will also come after your for additional costs after you finalize your package. On our way back to our old house, we passed by a “Phoenix Homes” sign and decided to give it one more shot. As we drove up to the sales office, we noticed that we were a bit early before opening time. As we turned around to leave, the door of the sales office was unlocked and we were greeted by the best sales person ever!
